PhotoGem is an AI-powered platform that transforms your jewelry product photos into professional-quality images. Our service includes:

• AI-enhanced jewelry photography in multiple professional styles
• High-resolution image exports (up to 4K quality)
• Lifestyle and model-shot generation
• Video content generation for product marketing

2. Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3. Credits and Payment

3.1 Credit System

Our service operates on a credit-based system. Credits are consumed when you generate images or videos. Credit consumption rates are displayed before each generation.

3.2 Free Credits

New users receive 20 free credits upon registration. Free credits have no expiration date but cannot be transferred or refunded.

3.3 Subscriptions

Subscription plans are billed on a recurring basis (monthly or yearly). Credits included in subscriptions refresh at the start of each billing period. Unused credits do not roll over to the next period.

3.4 Credit Packs

One-time credit packs are available for purchase. Credits from packs do not expire but are non-refundable once purchased.

3.5 Refunds

We offer a 7-day money-back guarantee for first-time subscription purchases. To request a refund, contact us at contact@photogem.app within 7 days of your initial purchase. Credit packs are non-refundable.

4. Acceptable Use

You agree NOT to use our service to:

• Upload content that infringes on intellectual property rights
• Generate images of products you do not own or have rights to
• Create misleading or fraudulent product representations
• Upload illegal, harmful, or offensive content
• Attempt to reverse-engineer or exploit our AI systems
• Resell or redistribute generated images as stock photography
• Use automated systems to abuse the service

5. Intellectual Property

5.1 Your Content

You retain ownership of the original images you upload. By uploading content, you grant us a limited license to process and transform your images for the purpose of providing our service.

5.2 Generated Images

You own the images generated through our service. You may use generated images for any commercial purpose, including selling products on platforms like Etsy, Amazon, Shopify, and eBay.

5.3 Our Service

PhotoGem, including our AI technology, website, and branding, remains our exclusive property. You may not copy, modify, or distribute our service or technology.

6. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. We may:

• Perform maintenance that temporarily affects availability
• Modify or discontinue features with reasonable notice
• Limit access during high-demand periods

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOGEM SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages exceeding the amount you paid us in the past 12 months

Our service is provided "as is" without warranties of any kind, either express or implied.

8. Indemnification

You agree to indemnify and hold harmless PhotoGem and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights

9. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through your account settings or by contacting support. Upon termination:

• Your access to the service will be revoked
• Unused credits will be forfeited
• We may delete your data after a reasonable retention period

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of California, USA.
